City of McHenry, IL DUI? Don’t Do The Field Sobriety Test.

If you are stopped for a

City of McHenry,  DUI: 

Don’t do the field sobriety test.

You all know, or should know that if the police ask you to do a breathalyzer back at the station, the suspension will be for 12 months or more.  However, did you know there is no penalty at all for refusing to take the field sobriety tests?  That’s right, turning down the roadside acrobatics costs you nothing and the police will have no evidence of you failing the field sobriety tests to present to the jury.
 

Now you may suggest that the field

sobriety tests will help you. 

You are wrong. 

The field sobriety tests are designed to do one thing.  Give the police something to talk about if you don’t take the breathalyzer.  That’s it, they are for nothing else.  If you decide to take the walk and turn the police will not tell you that there are eight clues they look for in that test, and if you fail any two they will testify that you are impaired.  One of the clues is starting the test before being asked and another is lifting your hands more than six inches from your sides.  Think about it, if you did everything else perfectly the officer would not testify how well you did, they would tell the judge or jury that based on their training you were under the influence, whether you were or not.

I am sure they will close this little loophole soon, so for now take Nancy Reagan’s advice and JUST SAY NO, to the field sobriety tests.
